These Terms & Conditions ("Terms") govern your access to and use of FundLoot (the "Service"), a personal-finance application provided by Abigail O'Rourke ("we", "us", or "our"). By creating an account or using the Service, you are entering into an agreement with Abigail O'Rourke.
1. Acceptance of these terms
By accessing or continuing to use the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service. If you are using the Service on behalf of an organization, you confirm you have authority to bind that organization; otherwise you confirm you are of legal age to form a binding contract.
2. The Service
FundLoot helps you plan your monthly budget, prioritize bills, savings and purchases, track earnings, and follow progress toward financial goals through a game-style experience. We may add, change, or remove features from time to time.
3. Your account
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it up to date.
4. Acceptable use
You agree not to misuse the Service. In particular, you must not:
- use the Service for any unlawful, fraudulent, or deceptive purpose;
- send spam or attempt to defraud us or other users;
- infringe the intellectual property or other rights of any person;
- interfere with or compromise the security or integrity of the Service, including introducing malware, probing or scanning, or scraping data; or
- reverse engineer, resell, or redistribute the Service or circumvent its technical limits.
5. Intellectual property
The Service, including its software, design, branding, and documentation, is owned by Abigail O'Rourke and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service under your selected plan. All rights not expressly granted are reserved. You retain ownership of the content and data you submit, and you grant us a limited license to host and process it solely to provide the Service.
6. Subscriptions, billing and payments
FundLoot is offered on a subscription basis with a free trial period, after which a recurring fee applies unless you cancel. Payment, billing, currency, tax, renewal, cancellation, and refund mechanics are handled by our reseller, Paddle. By subscribing you also agree to Paddle's Buyer Terms. 7. Reseller / Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
8. Service availability and warranties
We work to keep the Service available and reliable, but we do not guarantee that it will be uninterrupted, timely, secure, or error-free. To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose. FundLoot is a budgeting tool and does not provide financial, investment, legal, or tax advice.
9. Limitation of liability
To the fullest extent permitted by law, Abigail O'Rourke will not be liable for any indirect, incidental, consequential, or special damages, including loss of profits, data, or goodwill. Our total aggregate liability arising out of or relating to the Service is limited to the amount you paid for the Service in the twelve (12) months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded by law, such as for fraud, death, or personal injury caused by negligence.
10. Suspension and termination
We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay applicable fees, create a security or fraud risk, or repeatedly or seriously violate our policies. You may stop using the Service at any time. On termination, your right to use the Service ends; you may request an export of your data within a reasonable period before it is deleted.
11. Changes to these terms
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by the laws of the jurisdiction in which Abigail O'Rourke is established, without regard to conflict-of-law rules, and disputes will be subject to the courts of that jurisdiction, except where mandatory local consumer law provides otherwise.
